WBEC ORV Legal Disclaimer for ORVopoly 15^th Anniversary Game

To celebrate this year’s 15^th anniversary of Women’s Business Enterprise Council Ohio River Valley (“WBEC ORV”), WBEC ORV decided to create the ORVOPOLY 15^th Anniversary Game (“ORVOPOLY Game”), the proprietary creation of the Women's Business Enterprise Council Ohio River Valley (WBEC ORV). Corporate Members, Certified Companies, and Sponsors were all given the opportunity to participate in the game and provided company name, image, likeness, and other personal characteristics (“Materials”) to WBEC ORV.  By supplying any logos, trademarks, and likenesses to be included in this Game, we give WBEC ORV permission for such use and publicity with the ORVOPOLY Game. WBEC ORV acknowledges that the logos, trademarks, and likenesses to be included in the ORVOPOLY Game are the property of their respective owners and were provided by their respective owners (“Contributors”) to WBEC ORV to participate in the Game. The Contributors give a perpetual license, at no cost, for WBEC ORV and the ORVOPOLY Game including any marketing, advertising, promotions, and publicity by WBEC ORV without further consent from or royalty, payment, or other compensation whatsoever to the Contributors.  The use of any logos, trademarks, and likenesses is for educational and entertainment purposes only and any proceeds from the ORVOPOLY Game will go to fund the ORV Scholarship Fund and to promote the non-profit mission of WBEC ORV. 

 

WBEC ORV shall be the exclusive owner of all rights, including copyright, in the Material provided for the ORVOPOLY Game.  The Contributors acknowledge and agree that they will have no right to review or approve Materials before they are used by WBEC ORV for the ORVOPOLY Game or any marketing or promotion of the ORVOPOLY Game.  WBEC ORV shall be entitled to editing or alteration of the Materials to fit within the ORVOPOLY Game including the board, cards, etc.  WBEC ORV will provide credit to the Contributors for their participation.

 

A Contributor’s desire to participate in the ORVOLOPY Game and WBEC ORV’s use of the Materials does not imply any affiliation, endorsement, sponsorship, or partnership between WBEC ORV and the Participant’s as the owners of these logos, trademarks, and likenesses. 

 

WBEC ORV respects the intellectual property rights of others and strives to ensure that no unauthorized use of copyrighted material, trademarks, or likenesses occurs in the ORVOPOLY Game. All use of copyrighted material, trademarks, or likenesses were used by WBEC ORV after specific consent and permission.  If you are a trademark or copyright owner and believe that your rights are being infringed upon, please contact WBEC ORV immediately so that appropriate actions can be taken. 

 

This Waiver provides WBEC ORV with each Contributor’s absolute and unconditional consent, waiver, and release of liability, allowing WBEC ORV to publicize and commercially exploit the name, likeness, and other personal characteristics and private information including but not limited to logos, trademarks, and images as set out above. By participating in the ORVOLOPY Game, Contributors acknowledge that they have read and understood all of the terms of this waiver.   

 

Finally, by participating in or using the ORVOPOLY Game, you acknowledge and agree that WBEC ORV is not liable for any claims, damages, or losses arising from the use of logos, trademarks, or likenesses within the ORVOPOLY Game and specifically waive their rights to sue WBEC ORV. All Contributors and users assume full responsibility for their use of the ORVOPOLY Game and agree to indemnify and hold WBEC ORV harmless from any and all claims, damages, and expenses, including legal fees, arising from their use of the game.
